Business and Work Visas

Business visas are speciﬁcally designed for overseas businessmen with extensive business background, business & personal assets, who are interested in starting a new business or invest in Australia.

A business operating outside of Australia may also be able to sponsor employees to work in Australia on work visas, and to:

Establish or assist in establishing a business operation with connections to a business located outside Australia.
Fulfil or assist in fulfilling a contractual obligation.

Permanent skilled and employer nominated visa options are also available for potential businesses seeking employees.

Overseas Business Sponsors do not need to be operating in Australia but must meet all other employer eligibility requirements and the sponsorship obligations. The visa is granted for 4 years with full work rights to work for the sponsoring employer, in the nominated occupation.

Business innovation stream (Subclass 188A) – 4 Year Visa

This stream is a temporary visa, applicable for people with business skills who want to establish, develop and manage a new or existing business in Australia. You must:

Have had an overall successful business career
Be under 55 years of age (or meet age waiver requirements)
Have genuine intentions and realistic expectations for involvement as an owner of a new or existing business in Australia
Score at least 65 points on a point test. Points are awarded by the Department for age, assets, business turnover, business experience, language etc.
For 2 out of 4 fiscal years immediately before you are invited to apply, have had an ownership interest in an established business or businesses that had at least AUD500,000 turnover in each of those years
Own at least one of the following percentages of your nominated main business:

51 per cent, if the business has turnover of less than AUD 400,000 per year
30 per cent, if the business has a turnover of AUD 400,000 or more per year
10 per cent, if the business is a publicly listed company

Have combined net business and personal assets of more than $800,000(main applicant and spouse combined)
Be sponsored by a state or territory government

Investor stream (Subclass 188B) – 4 Year Visa (Can be converted to permanent visa after 2 years)

This stream is for people who want to make a designated investment of at least AUD1.5 million in an Australian state or territory and maintain business and investment activity in Australia. You must:

Be under 55 years of age
Score at least 65 points on a point test. Points are awarded by the Department for age, assets, business turnover, business experience, language etc.
Have an overall successful record of eligible investment or qualifying business activity
Have at least three years of experience of direct involvement in eligible investment
Have a genuine intention to live for at least two years in the state or territory in which you have made a designated investment of $1.5 million into a state or territory government bond for four years
Have at least $2.25 million of net business, investment and personal assets
Be sponsored by a state or territory government

Business Talent Visa (Subclass 132) – Permanent Visa Significant Business History

Have had an overall successful business career
Be under 55 years of age (or meet the age waiver requirement)
Have business turnover of AUD $3 million in 2 of the past 4 financial years in your nominated businesses (can be in 2 businesses combined)
$400,000 must be net business assets in your nominated businesses (not more than 2 businesses)
Have net business and personal assets of AUD $1.5 million (main applicant and spouse)
